Authority.

These contract terms and conditions apply to all bookings made with Brin Solutions Ltd, as well as any training course or event given by the company. If there is a discrepancy between these Terms & Conditions and other Terms & Conditions, these Terms & Conditions will take precedence unless Brin Solutions Ltd expressly agrees differently in writing. Without Brin Solutions Ltd’s prior written agreement, no changes to these Terms & Conditions can be made. The parties agree to subject to the jurisdiction of the nation in which the courses/events are held, and these Terms & Conditions of Contract will be interpreted in line with English Law.

Approval

Once the Client has completed and sent this form OR a Course Booking Form, these Terms & Conditions of Contract are confirmed as accepted by the Client.

Bookings for courses

Client purchase order numbers must be quoted on the Brin Solutions Ltd Course Booking Form or a Client Order Form must be submitted at the time of scheduling for booking courses or events. The Course Booking Form for all Track Safety Courses must be signed by your (Sponsor) Company Sentinel Administrator.

Booking Cancellation and Transfer

Clients who cancel courses with less than 14 days notice must pay the full course charge. If you book within 14 days of the start date of the course, you will not be eligible for a refund. A nominated delegate can be replaced for free up to 48 hours before the event. Brin Solutions Ltd will make every effort to hold all advertised and scheduled events. However, owing to unforeseeable circumstances, a certain event may need to be rescheduled or cancelled. In such instances, regardless of whether or not notification is given, Brin Solutions Ltd will not take any consequential liability.

Collateral

Except as a direct result of Brin Solutions Ltd or its employees’ negligence, the client must indemnify and keep harmless Brin Solutions Ltd for any claim resulting from injury to individuals or damage to third-party property. Brin Solutions Ltd is not responsible for any financial, economic, or consequential damages experienced by the client, whether directly or indirectly, as a result of the contract’s execution.

Payment

Before any training course may begin, individuals who are paying the courses by themselves must clear payment. Contact Brin Solutions Ltd for further information on how to make payments.

Course assignment and certification

Please note that we are not responsible for any certifications or documents that are lost in the mail. Re-ordering certificates/documents may incur additional fees. You will not be eligible for a refund once you have been assigned a course date. You will not be permitted to attend the course if you do not arrive on time on your scheduled course date, and you will be charged the entire cost.

Courses in Railways

Please remember that delegate places are not guaranteed and Joining Instructions will not be delivered until we receive a completely signed booking form from the sponsor along with purchase order details or credit/debit card payment. Bookings should be processed within 48 hours. Our reservation system works on a first-come, first-served basis; no reservations or holds are made. From 10:30 a.m. until 16:00 p.m., the training team takes reservations and answers questions.

Medical Requirements for PTS and E-Learning

All delegates must achieve the minimum Network Rail medical fitness level outlined in NR/L2/OHS/00124 (Competence Specific Medical Fitness Requirements), as well as the alcohol and drug screening requirements outlined in GE/RT8070 Issue 2. (Testing Railway Safety Critical Workers for Drugs & Alcohol). Prior to the course, the client must produce proof of this to Brin Solutions Ltd in the form of an original medical certificate or a copy endorsed in ink as a “true copy” by the employer. This only applies to PTS Basic Training. Prior to attending any rail training, it is a course requirement that all delegates have completed the required E-learning module. If delegates do not finish the E-learning module, we reserve the right to refuse acceptance of the delegate onto the course or to enable the delegate to continue the course. In such circumstances, the entire course charge must be paid.

Identification of the individual

Delegates must bring picture ID (passport, foreign ID card, or UK driving licence), two proofs of address, evidence of national insurance number, and two passport-sized pictures to any course.

Late arrivals/events missed

We reserve the right to refuse acceptance of a delegate onto a course/event or to allow the delegate to finish the course if the delegate arrives late or misses any course/event sessions. In such circumstances, the entire course charge must be paid.

Unauthorized Taping

During tests and training, we do not allow the use of records or cameras. If you are caught in possession of any recordings or photographs after entering the centre, you are in violation of our terms of service and will be prosecuted. Brin Solutions Ltd shall own any recordings or photographs taken. CCTV surveillance is in place 24 hours a day, 7 days a week.

Surveillance by CCTV

Video connected security cameras keep continuously recorded surveillance of the premises for your personal safety and security. In a court of law, video evidence can be used. All activities are documented in order to aid in the prosecution of any criminal activity that occurs at the facility.

There is no room for error.

Profanity, threats, or any other form of violence will not be permitted.
